Car Accident Injury Claims
In NSW claims for personal injuries arising out of car accidents are called CTP claims.
The NSW scheme has undergone significant reform and the types of compensation and the time limits for claiming that compensation have been changed.
If you have been injured in a motor vehicle accident you may be entitled to some compensation regardless of whether or not the accident was your fault.
The entitlement to compensation will depend upon:
- • Your role in the accident;
- • Whether you are a child or an adult;
- • Whether you were a pedestrian, a cyclist, a driver or a passenger;
- • The seriousness of your physical and /or mental harm injuries; and/ or
- • Whether you still reside in Australia.
What can be claimed?
Financial compensation can be claimed for: pain and suffering, past and future treatment expenses, past and future wage losses, past and future domestic assistance together with legal costs and disbursements.
Time limits
There are strict time limits with the different types of CTP claim sub-groups. You should seek urgent legal advice if you have been injured in a car accident, to ensure that you can access all the compensation to which you are entitled to claim.
